THE LEGAL STUFF

Terms & Conditions

Last updated: April 2026

Short version: be cool, pay your invoices, do not steal our work, and we will do the same for you.

1. Acceptance of Terms

By using pitchkitchen.com or engaging PitchKitchen LLC for any service, you agree to these terms. If you do not agree, do not use the site or engage us. Pretty straightforward.

2. Services

PitchKitchen LLC provides B2B messaging, positioning, sales enablement, and AI brand training services. Specific deliverables, timelines, and fees are defined in a separate Statement of Work or proposal signed by both parties.

3. Intellectual Property

The content on pitchkitchen.com — including the Magnetic Messaging Framework, NarcScore, AI Brand Twin, and Problem-Centric Marketing methodology — is our intellectual property. You are welcome to read it, share it, and quote it with attribution. You are not welcome to repackage it as your own.

Work product delivered to a client during a paid engagement is owned by the client upon final payment, except for the underlying frameworks and methods, which remain ours.

4. Payment Terms

Engagements are billed per the Statement of Work. Standard terms are 50% upfront and 50% on delivery, unless otherwise agreed in writing. Invoices are due net 15. Late payments incur a 1.5% monthly service charge.

5. Confidentiality

We treat everything you share with us — strategy, financials, customer lists, internal politics — as confidential. We do not share it with anyone outside our team without your written permission. You agree to do the same with our methods, deliverables, and pricing.

6. Limitation of Liability

We do our best work and stand behind it. That said, our total liability for any claim related to our services is capped at the fees you paid us in the 90 days before the claim. We are not liable for indirect, incidental, or consequential damages.

7. No Guarantees

We have helped clients triple pipeline, double close rates, and rebuild category leadership. We cannot guarantee specific results for your business — that depends on your team, your product, your market, and your follow-through. What we guarantee is that we will bring our best thinking and our full effort.

8. Governing Law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in New York County, New York.

9. Changes to These Terms

We may update these terms from time to time. The date at the top will reflect the most recent version. Continued use of the site after an update means you accept the new terms.
